Terms of Service
01Agreement to Terms
These Terms of Service govern access to and use of the TrendRadar platform, website, and application programming interfaces (the “Service”) provided by Trend Radar, LLC (“Trend Radar,” “we,” or “us”). By creating an account or using the Service, you agree to these Terms on behalf of yourself and the business you represent. If you do not agree, do not use the Service.
02Eligibility and Business Use
The Service is intended for business and professional use by individuals aged 18 or older who have authority to bind their organization. Customers are responsible for complying with all laws that apply to their own use of the Service and its outputs.
03Nature of the Service
The Service delivers market intelligence, forecasts, and estimates derived from aggregated public macro-market signals and de-identified industry telemetry. Forecasts are probabilistic and provided for informational purposes only. They do not constitute financial, legal, tax, customs, or investment advice, and they are not a guarantee of commercial results. Cost benchmarks and tariff classifications are indicative and should be verified with qualified professionals.
04Accounts and Security
You must provide accurate registration information, keep your credentials and API keys confidential, and promptly notify us of any unauthorized access. You are responsible for all activity that occurs under your account.
05Subscriptions, Fees, and Taxes
Paid plans are billed in US dollars in advance, monthly or annually, and renew automatically for successive periods of the same length until cancelled. Subscriptions may be managed or cancelled at any time from the account dashboard, and cancellation takes effect at the end of the current billing period. Fees exclude applicable taxes, which are itemized where required. Except where required by law or expressly stated in a signed order form, fees already paid are non-refundable.
06Acceptable Use
Your use of the Service is subject to the Acceptable Use Policy, which is incorporated into these Terms by reference.
07Intellectual Property and License
Trend Radar and its licensors retain all rights in the Service, including its models, scores, software, and underlying databases. Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service and its outputs for your internal business purposes. Resale, redistribution, or use of outputs to build a competing product is prohibited without our written consent.
08Confidentiality and Data Protection
Each party will protect the other party’s non-public information using reasonable care and will use it only to perform or receive the Service. Our handling of personal data is described in the Privacy Policy.
09Disclaimer of Warranties
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, Trend Radar disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy of forecasts, and non-infringement.
10Limitation of Liability
To the maximum extent permitted by law, Trend Radar will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue. Our aggregate liability arising out of these Terms will not exceed the fees paid by you for the Service in the twelve months preceding the claim.
11Term and Termination
Either party may terminate for material breach that remains uncured thirty days after written notice. We may suspend access immediately for violations of the Acceptable Use Policy or for non-payment. Provisions that by their nature should survive termination will survive.
12Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. The state and federal courts located in Delaware have exclusive jurisdiction over any dispute, and each party consents to that venue.
13Changes and Notices
We may update these Terms by posting a revised version and updating the effective date. We will notify account holders of material changes.
